Exclusive buyer representation

   An agency relationship between a buyer and a broker that cannot result in dual agency.

Agency
1) The relationship that exists when a person, known as the principal, contracts to another, the agent, to perform an act in that person's stead. 2) Common term for a firm offering representation.

Broker
A person who acts as an intermediary between two or more parties in connection with a transaction for a fee or commission.

Exclusive Agency
An agreement in which one broker has exclusive rights to represent the owner or tenant.

Exclusive agency agreement
This is an agreement signed between the vendor and agent that gives the agent a exclusive period of time (usually 3 months) where the agent is the only person who can introduce buyers to the property.

Exclusive agency buyer agency agreement
Similar to the exclusive buyer agency agreement, this is an exclusive contract between the buyer and the agent.

Exclusive agency listing
A written agreement between a real estate broker and a property owner in which the owner promises to pay a fee or commission to the broker if specified real property is leased during the listing period.

Exclusive authorization and right to sell listing
A written listing agreement appointing a broker as the exclusive agent for the sale of property for a specified period of time.

Exclusive authorization to acquire real property
A contract providing for the exclusive representation of a buyer by a broker. It authorizes a broker to act as the exclusive agent of the buyer.

Exclusive buyer agency agreement
This is a completely exclusive agency agreement. The buyer is legally bound to compensate the agent whenever the buyer purchases a property of the type described in the contract.

Exclusive listing
A written contract that gives a licensed real estate agent the exclusive right to sell a property for a specified time.

Exclusive right of sale listing
A written agreement between an agent and a property owner stating that the owner will pay a commission to the agent if the property is sold during a specific time period.

Exclusive right to sell
Listing agreement under which the owner promises to pay a commission if the property is sold during the listing period by anyone, even the owner.

Exclusivity
A restriction on the tenant's right to open a competing retail outlet within a certain area of leased premises.
